These Terms of Service form the agreement between you and Tyrs Treat Trove LLC for the use of this website and for any service that the company delivers from the trove room. The company is Tyrs Treat Trove LLC, and its contact address is Huntington - 84528, United States (US). The desk is reachable at bookings@tyrstreattrove.mom and on +18047013712. Please read the whole of this document before you confirm a booking, because a confirmed booking means that you accept these terms, including the cancellation rules in section 11 and the limits in section 16. The document is written in plain English, and every heading names the subject that the section covers.
1. Agreement and parties
This agreement is made between Tyrs Treat Trove LLC, with a recorded address at Huntington - 84528, United States (US), and the person or organisation that uses the website or books a service. The company operates under the developer and business publisher name Tyrs Treat Trove and trades from a single trove room. In these terms the word company means Tyrs Treat Trove LLC, and the word client means the person or organisation that books a service or that uses the website.
By using the website you accept these terms as they stand on the date of use. By confirming a booking you accept these terms as they stand on the date of confirmation, together with the written booking summary that the desk sends you. If a booking summary and these terms conflict, the booking summary controls for that booking, because it records the specific promise that both sides made.
If you do not accept these terms, please do not use the site and do not confirm a booking. A general question sent to the desk does not by itself create a booking or a binding promise, as section 5 explains.
2. Definitions used in these terms
The following definitions apply throughout the document. A term that is not listed here carries its ordinary meaning in business English.
- Booking means a confirmed reservation of a service window on the trove calendar.
- Service window means a reserved period described in the catalog, such as a fitting session or a keepsake week.
- Trove room means the working space where fittings, assembly and audits take place.
- Cabinet plan means the written plan of drawer measurements, shelf count and color story prepared at a fitting.
- Key tag means the small tagged record that names the booking windows and the last audit pass.
- Deliverable means a physical or written result of a booking, including a keepsake box, a load plan or an audit note.
- Desk means the person or persons who answer the email address and the telephone number of the company.
- Working day means a day that is not a Saturday, a Sunday or a public holiday in the location of the trove room.
3. Eligibility and capacity
You must be at least eighteen years of age to confirm a booking in your own name. If you book on behalf of an organisation, you confirm that you have authority to bind that organisation to these terms. A parent or guardian may book a service for a family occasion, and the adult who confirms the booking remains the client for every purpose, including payment, cancellation and the guest list.
The company may decline a booking where the requested window cannot be delivered safely, where an earlier payment remains outstanding, or where a request falls outside the service catalog. The desk explains a refusal in writing and does not take a deposit for a window that it has declined.
4. The service catalog
The company offers six service windows. Each window has its own scope, and the full description of the scope is published on the services page. The six windows are the Trove Fitting Desk, Candy Curation Rounds, Keepsake Box Weeks, Party Stash Days, Tasting Shelf Sessions and Restock Audit Evenings.
The catalog describes the standard scope of each window. A booking summary may add a specific task or remove a standard element, and in that case the written summary controls. The company does not deliver a service that the summary does not describe, and the client is not obliged to accept an addition that the client did not request.
A fitting session is required before any production window, because every later window is scheduled against the cabinet plan. A client who already holds a current cabinet plan may begin with a production window, and the desk will confirm that the plan is still valid before a date is held.
5. How a booking is made
A booking follows four steps. First, you send an enquiry through the contact form, by email or by telephone. Second, the desk replies with available windows and a price band. Third, you confirm a window in writing and provide the information that the window needs. Fourth, the desk sends a booking summary and, where a deposit is due, an invoice. A booking exists only when the desk has sent the summary and, where a deposit applies, the deposit has cleared.
An enquiry is not a reservation. A window that appears on a reply is held for two working days from the time of the reply unless the reply states a different period. After that period the window returns to the calendar and may be offered to another client.
The desk keeps a written record of each booking summary. If you believe that a summary contains an error, tell the desk within two working days of receiving it. A correction agreed in writing becomes part of the booking, and a correction that changes the price is re-issued as a revised summary.
6. Prices, quotes and taxes
A price band is quoted after the fitting, because the shelf count, the wrapper finish and the length of the window move the cost more than volume does. A quote is valid for fourteen days from the date of issue unless the quote states otherwise. A quote covers the labour and the materials described in the summary, and it excludes any item that the summary does not list.
Prices are stated in United States dollars. A sales tax or a similar charge is added where the law requires it, and the invoice shows the amount separately. A client who supplies a valid exemption certificate is not charged a tax that the certificate covers.
Where a supplier raises a material cost between the quote and the booking, the desk may ask for a revised quote before the window is confirmed. The client may accept the revision or cancel the window without a cancellation charge. The company does not raise a price after the summary is confirmed unless the scope changes at the request of the client.
7. Payment terms
A deposit of one third of the quoted amount secures a service window, and the balance is due before the window opens. A fitting session may be paid in full at the desk. A keepsake box week requires the balance no later than five working days before the first assembly day, because the materials are ordered in advance.
Payment is made by the method shown on the invoice. The company does not accept a card number sent by email or through the contact form, and it does not store a full card number. A payment is treated as received when the processor or the bank confirms it, not when the client presses send.
An invoice that remains unpaid after the due date may result in the suspension of the window after a written reminder and a grace period of three working days. Where a window is suspended for non-payment, the cancellation rules in section 11 apply to the deposit already received. The company may charge a reasonable administration fee for a returned payment, and it will tell the client the amount before charging it.
8. Scheduling and the trove calendar
The trove calendar holds one production window at a time. A fitting session takes ninety minutes, a curation round takes about three hours, a tasting session runs seventy-five minutes, an audit evening takes about ninety minutes, a party stash day occupies one day and a keepsake box week occupies seven working days.
A window begins at the confirmed start time. A client who arrives more than twenty minutes late may lose part of the window, and a client who arrives more than forty-five minutes late may be treated as a no-show, in which case section 11 applies. The desk will try to accommodate a delay where the calendar allows, but it cannot extend a window into another booking.
The desk may reschedule a window where a material supply is unavailable or where a room condition makes delivery unsafe. The desk gives as much notice as possible, offers at least two replacement dates and does not charge a rescheduling fee for a change that the company causes.
9. Client responsibilities and information
The client agrees to provide accurate information that a window needs, including a name spelling, a date, a drawer measurement where relevant and any allergy or dietary note that affects a tasting session. An error in the information supplied may produce a wrong plate, a wrong load plan or a shelf that does not fit, and the client is responsible for the cost of a correction that the error makes necessary.
The client agrees to answer a proof request within the stated period. Where the client does not answer, the desk may proceed with the last approved proof or may move the window, and it will say which course it intends to take before it acts.
The client is responsible for ensuring that every name supplied on a guest list may lawfully be used for the purpose of printing a plate or labelling a box. The client confirms that a person named on the list has not objected to the use of the name for that purpose.
10. Guest lists, proofs and printed plates
A keepsake box week includes a proof stage. The desk sends a proof sheet and asks for approval in writing. A plate is fixed only after the proof is approved. The company is not responsible for a spelling error that appears on an approved proof, although the desk will try to correct a plate where the error is discovered before the plate is fixed to a box.
A plate that has been fixed to a delivered box cannot be altered without rebuilding the box. Where a rebuild is possible, it is quoted as a new task, and the original delivery stands. The client keeps the original box and may keep or discard the replacement at the client discretion.
A guest list remains the confidential information of the client. The desk does not use a list for marketing, does not sell a list and deletes a working proof register after the retention period described in the privacy policy.
11. Cancellation, rescheduling and refunds
The cancellation rules below aim to be fair to both sides. The company commits materials and room time in advance, and the client needs a clear expectation before booking.
Cancellation by the client
- More than fourteen working days before the window: the deposit is refunded in full, less any payment processor charge that the company cannot recover.
- Between seven and fourteen working days before the window: the deposit is retained, and the balance is not due.
- Fewer than seven working days before the window: the full quoted amount is due, where materials have been ordered or assembly has begun.
- A no-show on the day: the full quoted amount is due, and the window is not re-offered.
Rescheduling by the client
A client may reschedule once without charge where the request arrives at least seven working days before the window. A second reschedule, or a reschedule requested inside seven working days, is treated as a cancellation under the rules above, unless the desk agrees otherwise in writing.
Cancellation by the company
Where the company cancels a window for a reason within its control, the client receives a full refund of every amount paid for that window, or a replacement date at the client choice. A refund is issued to the original payment method within ten working days of the cancellation being agreed.
A request for a refund must be made in writing to bookings@tyrstreattrove.mom. The desk confirms receipt and gives the expected date of the refund in the same reply.
12. Allergies, dietary needs and safe handling
A tasting shelf session may involve ingredients that are commonly associated with an allergy, including milk, nuts, wheat, soy and sesame. The client must tell the desk about any allergy or dietary need before the first card is turned, and the desk will arrange a separate place or a different shelf plan where it can. The company cannot guarantee an environment that is free from traces of an allergen, because the trove room handles a range of stock.
A guest with a serious allergy should not rely on the desk to screen every ingredient. The desk will show the wrapper labels on request, and a guest with a medical condition should follow the advice of a clinician. If a reaction occurs, the desk calls emergency services and follows the trained first aid procedure in the room.
A keepsake box is a food product. The client is responsible for storing the box in a cool, dry place after it leaves the trove room and for observing any shelf life note supplied with the box. The company is not responsible for a box that is stored in a warm place after handover.
13. The trove room and conduct during visits
The trove room is a working space with open shelves, paper records and a tasting bench. A client and the guests of a client are asked to follow the directions of the desk, to keep food and drink away from the paper records and to treat the cabinet with care. A guest who damages a fixture may be asked to pay for the repair at a reasonable cost, and the desk will provide an itemised note before charging.
Smoking, an open flame and an unauthorised animal are not permitted in the trove room. A service animal is welcome where the law requires it, and a client should tell the desk in advance so that the room can be prepared. A client who requires a step free route or another adjustment should tell the desk at the booking stage, and the desk will confirm what the room can offer before the date.
The desk may end a visit where a person behaves in a way that endangers another guest or a member of staff. In that situation the window is treated as delivered and no refund is due, although the desk will record the reason in writing.
14. Intellectual property and content ownership
The text, layout, cabinet plan template, catalog descriptions and visual design of this website belong to Tyrs Treat Trove LLC. A visitor may read, print and store the pages for personal use. A visitor may not copy the catalog text into another website, resell the design or use the company name to imply an endorsement without written permission.
A cabinet plan prepared for a client remains the working record of the company, and the client receives a copy for personal use. The client may share the plan with a designer or a venue, but may not republish it as a commercial product. A photograph taken by the desk during a booking belongs to the company, and the company will not publish a photograph that identifies a person without written permission.
A client who sends a photograph of a drawer or a sample box grants the desk a limited licence to use that photograph for the single purpose of preparing the plan. The licence ends when the booking closes, and the photograph is deleted under the retention rules in the privacy policy.
15. Acceptable use of the website
You may use the website for its intended purpose, which is to learn about the service and to contact the desk. You agree not to attempt to gain unauthorised access to the site or to its hosting environment, not to send automated traffic that degrades the site for other visitors, and not to use the contact form to send unlawful, threatening or deceptive content.
The website is provided as a static set of pages. The company may change, suspend or withdraw a page at any time, and it does not guarantee that a page will always be available. A link that is broken should be reported to the desk at bookings@tyrstreattrove.mom, and the desk will repair it where it can.
16. Disclaimers and limitation of liability
The company provides the service with reasonable skill and care. Beyond that promise, the website is provided as it stands and the company does not make a warranty that a page will be free from error or that a description will match every future supply. The company does make a firm promise about the scope recorded in a booking summary, and it will fix a failure in that scope at no additional charge.
To the fullest extent that the law allows, the company is not liable for an indirect loss, a loss of profit, a loss of opportunity or a loss that was not reasonably foreseeable when the booking was confirmed. The total liability of the company for a booking is limited to the amount paid for that booking, except where the law does not permit a limitation, for example in a case of death or personal injury caused by negligence, or in a case of fraud.
Nothing in these terms removes a right that a consumer holds under a law that cannot be excluded by agreement. If a term in this section is found to be unenforceable, the remaining terms continue in force and the unenforceable term is read down to the minimum extent that the law permits.
17. Indemnity
You agree to cover the company against a reasonable loss or cost that arises from a breach of these terms by you, from a name list that you were not entitled to share, or from damage that you or your guests cause in the trove room. This cover applies only to the extent that the loss is the fault of the client and does not apply to a loss caused by the company.
Where a third party makes a claim against the company because of content that a client supplied, the client will cooperate in the defence of the claim and will provide the documents that the claim needs. The company will tell the client promptly when it receives a claim of that kind.
18. Force majeure and supply interruption
The company is not liable for a delay or a failure caused by an event outside its reasonable control, including a severe weather event, a fire, a flood, a power failure, a transport strike, a failure of a public network or a government order. The company will tell the client as soon as it becomes aware of the event and will discuss a replacement date.
Where a force majeure event continues for more than thirty days, either side may end the affected booking without a cancellation charge, and the company refunds every amount paid for a window that was not delivered. A refund is issued within ten working days of the booking being ended.
A routine supply delay, such as a late delivery of a wrapper, is handled under section 8 and is not treated as a force majeure event unless the delay makes delivery impossible.
19. Privacy and data protection
The company handles personal information as described in the privacy policy published at the privacy page. The privacy policy explains what information is collected, why it is collected, how long it is kept and how a person may exercise a right over it. The privacy policy forms part of these terms, and a reference to it here does not reduce the rights that it explains.
A client who supplies a guest list confirms that the names may be used for the purpose of the booking. The company does not use a list for marketing, and a guest may ask the desk to remove a name from a working register as described in the privacy policy.
20. Termination and suspension
The company may suspend or end a booking where a client fails to pay, where a client supplies false information, where a client behaves in a way that endangers staff or guests, or where a legal or safety requirement makes delivery impossible. The company will normally give written notice and a chance to fix the problem, except where the problem is urgent.
A client may end a booking under the rules in section 11. Where a booking is ended, the sections that concern payment, intellectual property, liability, indemnity and governing law continue to apply, because they describe the record that both sides need after the service ends.
21. Governing law and dispute resolution
These terms are governed by the law of the United States and of the state in which the trove room operates, without regard to a conflict of law rule. The parties agree to try to resolve a dispute through a written conversation first, and the desk will answer a written concern within twenty working days.
Where a conversation does not resolve the matter, the parties may agree to a neutral mediator before starting a court process. A consumer who holds a right to bring a claim in a local court keeps that right, and nothing in this section prevents a party from seeking urgent relief where a delay would cause harm.
22. Changes to these terms
The company may update these terms to reflect a change in the catalog, a change in the law or a change in the way a window is delivered. An update is published on this page with a new effective date. A booking that is already confirmed is governed by the terms in force when it was confirmed, unless the client agrees in writing to a later version.
A material change is also sent to a client with an open booking by email, with a short note explaining what changed and when the change takes effect. A reader who does not agree with a change may stop using the website and may cancel an unstarted booking under section 11.
23. General provisions and notices
A notice under these terms must be in writing. A notice to the company is delivered when it arrives at bookings@tyrstreattrove.mom or when it is handed to the desk at the trove room. A notice to the client is delivered when it is sent to the email address that the client supplied for the booking.
These terms, the booking summary and the privacy policy form the whole agreement between the parties for a booking. A previous conversation or a marketing description does not add a term unless it is written into the summary. If one term is found to be invalid, the remaining terms continue, and the parties replace the invalid term with a valid term that comes closest to its purpose.
A delay in enforcing a term is not a waiver of that term. The company may assign its rights on a sale of the business, provided that the new owner honours an existing booking. The client may not assign a booking without the written agreement of the desk, because the room and the plan are tied to a specific window.
24. Contact information
Tyrs Treat Trove LLC is the party to these terms. The recorded address is Huntington - 84528, United States (US). The desk answers email at bookings@tyrstreattrove.mom and telephone calls at +18047013712. Business hours are published on the contact page. A question about a booking, an invoice or a privacy request receives a written reply within two working days.
